These Terms govern your use of vivantacare.com and the related platform operated by Vivanta Care (“Vivanta Care,” “we,” “us”). By using the service you agree to these Terms.
Eligibility
You must be 18 or older and a U.S. resident located in a state where our clinicians are licensed. You agree to provide accurate, current, and complete information.
Not a medical provider; no emergencies
Vivanta Care is a technology platform. It does not provide medical advice, diagnosis, treatment, or medication. Clinical services are provided by an independent medical group. The platform is not for medical emergencies; call 911 or go to the nearest emergency room.
No clinician–patient relationship from this site
Browsing the site or submitting an intake does not create a clinician–patient relationship. A relationship begins only after a clinician accepts you for care.
Prescription medications
Prescription medications require a medical evaluation and are not appropriate for everyone. Whether to prescribe a medication, and which medication, is solely a clinical decision made by your treating clinician. Vivanta Care does not guarantee any treatment outcome.
Payments and subscriptions
You authorize us to charge your payment method for the fees disclosed at signup. Subscriptions renew automatically until canceled. See our Refund Policy.
Acceptable use
- Do not misrepresent your identity, medical history, or location.
- Do not share, resell, or divert medication.
- Do not attempt to access another user's account or interfere with the service.
Intellectual property
The site and its content are owned by us or our licensors. You may not copy, modify, or distribute it except for personal, non-commercial use.
Disclaimers
The site is provided “as is.” We disclaim all warranties to the maximum extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of the site is limited to the amounts you paid to us in the twelve months before the claim.
Indemnification
You agree to indemnify us against claims arising from your misuse of the service or violation of these Terms.
Dispute resolution
Disputes will be resolved by binding arbitration on an individual basis, except where prohibited by law. You may opt out within 30 days of accepting these Terms by emailing info@vivantacare.com.
Governing law
These Terms are governed by the laws of the state of CA, without regard to conflict-of-laws principles.
Changes
We may update these Terms; continued use after changes means you accept them.
